Terms and Conditions
Scope of Application
All business relations between Café-Koenig and the customer without exception are subject to the general sales terms and conditions, valid at the time of order.§ 1 Conclusion of Contract
A contract between Cafe-Koenig.com and the customer comes into effect when the order is being made by the customer (sending-off of the Shopping Trolley) and is being accepted by Cafe-Koenig.com (confirmation of order).§ 2 Right of Withdrawal
According to decree no. 206 of September, 6th, 2005, relevant version at time of conclusion of the contract, the consumer is entitled to withdraw from the contract within 10 working days the latest after receipt of the goods. The affidavit must be sent by email or fax (+39 0473 258189) to Café König, I-39012 Meran (BZ). The customer is obliged to return all delivered goods to the same address at his own expense within 24 hours after having sent the affidavit.This affidavit is not valid for contracts applicable to art. 46, paragraph 1, letter b) of the decree no. 206 of September, 6th, 2005.
Customers not being consumers according to the mentioned legal requirements can withdraw their order by sending an immediate email or fax (+39 0473 258189) to Café Koenig. Thereupon, we confirm the annulment of the order. The annulment of the order must be done within 24 hours after having placed the order and in any case before the ordered goods have left our stocks.
§ 3 Prices
Our prices are quoted in Euros. The amount in Euros will be shown on the order confirmation and includes VAT. Shipping costs and possible customs duties are not included.§ 4 Delivery
Delivery is made at risk and expense of the buyer. The risk passes onto the buyer when the goods leave our stocks. The ordered goods are delivered by a courier. Should ordered goods not or only partially be available, we will inform you as soon as possible (by email or by direct contact). In that case, we reserve the right to dissolve the contract. The customer affirms to have communicated the correct address and undertakes to compensate extra costs occurring by having furnished a wrong or incomplete address. Invoices are due strictly net C.W.O. and can be settled by Credit Card.We accept Visa, Master Card, Euro Card, Diners Club, American Express and Cartasí. Please enter your Credit Card data when placing the order. Your data will be transferred to our server by a secure 128 Bit SSL access. After the Clearing Process your information will be automatically deleted from this server. In that way we are able to guarantee the highest security standard possible.
§ 6 Non-Liability
Claim for indemnity caused by delay, impossibility, positive demand violation or tortious act are not covered, unless the claim has been caused by grossly negligent or wilful act.§ 7 Damages in transit
The buyer will check the delivered goods. Externally visible damages are noted down on the transport documentation by the buyer and confirmed by the courier when accepting the goods; the damaged packing is to be conserved. Should the (partial) incurred loss not be visible from outside, the buyer has to communicate the damage found within one (1) day after delivery to Café-Koenig, in order to guarantee an assertion of the claim with the courier in time. The buyer will do his utmost to support Café-Koenig in adjusting possible claims with the respective courier or insurance.§ 8 ROR
Without prejudice of terms of the Italian Consumer Code (decree no. 206 of the 6.9.2005) a right of return is excluded as foodstuffs are concerned.§ 9 Jurisdiction
Without prejudice of terms of the Italian Consumer Code (decree nr. 206 of the 6.9.2005) every dispute is subject to the Court of Jurisdiction is in Merano/Meran (Italy) and the application of Italian Law.§ 10 Data Protection
Personal data necessary for closing the contract will be supplied by the buyer. Personal data needed for the purchasing process will be saved (if necessary) during the proper completion of the ordering process. We guarantee highest security and are committed to protect your data from unauthorised access by third parties.Information according to the law 196/2003:
- The data concerning your person is stored electronically in order to process your request and to send you advertising material about our company.
- Your rights provided by Art. 7 of the law 196/2003 are reserved.
